എം. ഏ ബേബിയുടെ സോഫ്റ്റ്വെയര്‍ ചിന്തകള്‍

എം. ഏ ബേബി സ്വതന്ത്ര സോഫ്ററ്വെയര്‍ മഹാമഹത്തില്‍ ഒരു മഹാപ്രസംഗം നടത്താതിരിക്കാന്‍ നിര്‍വ്വാഹമില്ലല്ലോ. ആ മഹാ പ്രഭാഷണം ആംഗലേയത്തില്‍ ആയതു നന്നായി, കുസാറ്റ് വെബ്സൈറ്റില്‍ പി ഡി എഫ് രൂപത്തില്‍ കൊടുത്തതും നന്നായി. നാലാളു കാണണമല്ലോ. നാലാം കിട മാര്‍ക്സിസ്റ്റുകാര്‍ക്ക് പകരംവെയ്ക്കാനില്ലാത്ത platitudes ന്‍റെ കൂത്താണ് പ്രഭാഷണം. "Creation of knowledge is a continuous process. Nothing is created from nothingness. The new knowledge created has its origin in the past. Thus those who claim that they have created something new are negating history." ഓക്കാനം വരുന്ന platitudes. അതിലിപ്പോള്‍ എന്തു പുതുമ. പക്ഷേ പുതുമയുള്ള ചിലതു പെട്ടെന്നുതന്നെ കണ്ണില്‍പ്പെടതുകൊണ്ട് അത് എടുത്തുപറയട്ടെ. ആദ്യമേ പറയട്ടെ, ബേബിയുടെ പ്രസംഗം മുഴുവന്‍ വായിക്കാന്‍ ഈയുള്ളവനു ക്ഷമയില്ല. ബേബിയല്ലേ, എന്തു പറയുമെന്നു ഊഹിച്ചൂടേ. നാലാംകിട ബുദ്ധിജീവി വര്‍ത്തമാനമാണ്: When a society achieves freedom in all the above respects, it is said to have attained Samata. The intellectual creations of individual nations become common property." 1848ലെ ഒരു കൃതിപോലും പുതിയ കാര്യമായി കാണാത്ത കാര്യമാണ് ബേബി കണ്ടുപിടിത്തമായി അവതരിപ്പിക്കുന്നത്. മന്ത്രി ഏതു ലോകത്താണ്? പിന്നെയും കാച്ചിവിട്ടിരിക്കുകയാണ്: "So far land, building, machinery and raw materials were the only items listed under the definition of private property. Now the corporates have realized that it is no longer possible to keep these as strictly private, to keep the exclusive ownership of these items. ഫ്രീ സോഫ്റ്റ്വെയറും അല്പന്മാരും

യെച്ചൂരിയുടെ മഹാപ്രസംഗം കേള്‍ക്കാന്‍ പതിവുപോലെ CUSAT ലെ ഒരു പ്രൊഫെസറുടെ bulk mail ക്ഷണം കിട്ടി നോക്കിയപ്പോള്‍ കണ്ട ഈ വെബ് പേജ് കണ്ട് സഹിയാതെ നേരമില്ലാത്ത നേരത്ത് കുറിക്കുകയാണ്. ഇതാണ് പേജ് http://www.cusat.ac.in/free_software_conf.php അതിലെ ഒരു മുഖ്യ ലിങ്ക് ഇതാ, National Conference on Free Software Web Site ഫ്രീ സോഫ്റ്റ്വെയറിനെപ്പറ്റി ഇനിയൊരു പുതിയ വെബ്സൈറ്റിന്‍റെ കുറവേയുള്ളൂ. ഈ വിദ്വാന്മാര്‍ ‍ അതു പരിഹരിക്കാനാണ് ഈ മഹാമഹം നടത്തിയത്!യെച്ചൂരിയുടെ പ്രസംഗം ogg format ല്‍ download ചെയ്തെടുത്തു കേള്‍ക്കണം. അതു transcribe ചെയ്യാന്‍ പറ്റിയ സഗാക്കളെ ആരെയും കിട്ടിക്കാണില്ല. മന്ത്രിയുടെ പ്രസംഗം text ഉണ്ട്, വായിച്ചിട്ട് ബാക്കി പറയാം. "Awake, the struggle for existence unreveals here…" എന്നു സ്വന്തം വെബ്സൈറ്റിന്‍റെ ബേനറില്‍ തന്നെ എഴുതിവെച്ച ഒരു മഹാവിദ്യാര്‍ത്ഥി പ്രസ്ഥാനമായിരുന്നു ഇതിന്‍റെ സംഘാടകരില്‍ പ്രധാനരെന്നു കേട്ടു. മഹാമഹത്തിനിടെ ഏതോ സ്പോണ്‍സര്‍ കമ്പനിക്കെതിരെ പോസ്റ്ററു പതിക്കാന്‍ പോയ യുവാക്തിവിസ്റ്റിനെ ചിലര്‍ കോളറില്‍ പിടിച്ചെന്നോ വലിച്ചെന്നോ അടിച്ചെന്നോ ഒക്കെ കേട്ടു. അത് "ഔദ്യോതിക velidictory"-യില്‍ വരില്ലല്ലോ.

സുകുമാര്‍ അഴീക്കോടിന്‍റെ ഭാഷാശാസ്ത്രം

(ലേഖനത്തിനു വിഷയമായ കാര്യത്തെപ്പറ്റിയല്ല ഈ കുറിപ്പ്. പണ്ഡിതന്മാര്‍ എന്ന പേരു പേറുന്നവര്‍ എഴുതിക്കൂട്ടുന്ന വിവരക്കേടുകളെപ്പറ്റി മാത്രമാണിത്. alimentary canal എന്നാല്‍ വായമുതല്‍ ഗുദം വരെയുള്ള അന്നനാളമെന്നും (അയ്യപ്പപ്പണിക്കര്‍) parabola എന്നാല്‍ ഉമപാലങ്കാരമെന്നും, platoon എന്നാല്‍ പടര്‍പ്പ്, വള്ളിക്കെട്ട് എന്നും (കൃഷ്ണവാര്യര്‍) ഒക്കെ എഴുതി പ്രസിദ്ധീകരിക്കുന്ന മഹാപണ്ഡിതന്മാരായ പ്രഫസറന്മാരുടെ കൂട്ടത്തിലേക്ക് ഇനിയും മുതല്‍ കൂടട്ടെ.)
തെലുഗു, കന്നഡ ഭാഷകള്‍ക്ക് സര്‍ക്കാര്‍ ക്ലാസിക് പദവി കല്പിച്ചു നല്കിയതിനെപ്പറ്റി അഴീക്കോട് എഴുതിയ ലേഖനം ഇന്നാട്ടിലെ പണ്ഡിതശിരോമണികളുടെ തനിനിറം കാണിക്കുന്നതുകൊണ്ട് ഇവിടെയൊന്നെടുത്തു പറയുകയാണ്. "വേലിയിലുള്ളത് ശീലയിലാക്കി" എന്നു പരിഷ്കരിച്ചു വികലമാക്കിയ ഒരു ചൊല്ല് പറഞ്ഞുകൊണ്ടാണ് ലേഖനം തുടങ്ങുനന്നത്. പച്ചയ്ക്കങ്ങു പറഞ്ഞാല്‍ പോരേ? വേലിയിലിരിക്കുന്ന പാമ്പിനെയെടുത്ത് കോണത്തിലിടുക എന്നതാണ് ശരിക്കും ലേഖനകര്‍ത്താവ് ചെയ്തിരിക്കുന്നത്.
"ക്ലാസിക്‌ സാഹിത്യം എന്നു കേട്ടിട്ടുണ്ട്‌. ക്ലാസിക്‌ ഭാഷ എന്നൊന്നില്ല."
ഇതാണ് സുകുമാര്‍ അഴീക്കോടിന്‍റെ വാദം. ഇല്ലെങ്കില്‍ വേണ്ടാ. ആരെങ്കിലും ഉണ്ടെന്നു പറഞ്ഞോ? കാര്യമിത്രയേയുള്ളൂ. classic എന്നും classical എന്നുമുള്ള പദങ്ങളുടെ വ്യത്യാസം ശ്രീമാന് അറിഞ്ഞുകൂടാ.ഒന്നാമത് സര്‍ക്കാര്‍ കല്പിച്ചുകൊടുത്ത വങ്കന്‍ പദവി ക്ലാസിക് ഭാഷ എന്നല്ല, ക്ലാസിക്കല്‍ ഭാഷ എന്നാണ്. ഇതു സംബന്ധിച്ച സര്‍ക്കാര്‍ പത്രക്കുറിപ്പ് ഇവിടെ കാണാം. അവസാനം കാണുന്ന "dispose off" മാറ്റിനിറുത്തിയാല്‍ അഴീക്കോടിനെക്കാള്‍ വിവേചനബുദ്ധിയുണ്ട് കുറിപ്പെഴുത്തുകാരന്. ചാള്‍സ് ഡിക്കിന്‍സിന്‍റെ Great Expectations എന്ന കൃതി ഒരു ക്ലാസിക്കാണെന്നു പറയാം. എന്നാല്‍ ആരും അതിനെ ക്ലാസിക്കല്‍ എന്നു പറയില്ല. സാഹിത്യത്തെ സംബന്ധിച്ച് ക്ലാസിക്ക് എന്നതിനും ക്ലാസിക്കല്‍ എന്നതിനും വെവ്വേറെ വിവക്ഷകളുണ്ട്. മൊത്സാര്‍ട്ടിന്‍റെ സംഗീത രചനകള്‍ ക്ലാസിക്കല്‍ സംഗീതമാണ്. ബീറ്റില്‍സ് ബാന്‍ഡിന്‍റെ പല പാട്ടുകളും ക്ലാസിക്കുകളാണ്, എന്നാല്‍ അവയെ ക്ലാസിക്കല്‍ എന്നു പറയാറില്ല. ക്രിക്കിറ്റ്, ചലച്ചിത്രഗാനം എന്നിവയിലൊക്കെ ഈ പദങ്ങള്‍ വലിയ കണിശത കൂടാതെ ഉപയോഗിച്ചു കാണാറുണ്ട്. എന്നാല്‍ നൂറ്റാണ്ടുകളുടെ scholarship നിലനില്‍ക്കുന്ന മേഖലയില്‍ അഴുകൊഴമ്പന്‍ പദാവലി നടപ്പില്ല. ഇനി അതല്ല classical language എന്നൊന്നേയില്ല എന്നാണ് അഴീക്കോടു പറയുന്നതെങ്കില്‍ അദ്ദേഹത്തിന്‍റെ അറിവില്ലായ്മയെ ഓര്‍ത്ത് സഹതപിക്കാനേ നിവൃത്തിയുള്ളൂ. http://en.wikipedia.org/wiki/Classical_languages ഒടുക്കം ഒരു കഥ പറഞ്ഞുകൊണ്ടാണ് അഴീക്കോട് നിറുത്തുന്നത്.
"സംഗീതത്തെപ്പറ്റി ഒരു ഗന്ധവുമില്ലാതിരുന്ന ഒരു രാജാവ്‌ ദേവന്മാരുടെ ഒരു ഗാനമത്സരത്തില്‍ തെറ്റായ തീരുമാനം എടുത്തതില്‍ കോപിച്ച അപ്പോളോ ദേവന്‍ രാജാവിനു കഴുതച്ചെവി നല്‌കിയെന്ന കഥ കേട്ടിട്ടുണ്ട്‌. കേന്ദ്രത്തില്‍ ഉള്ളതും ആ ഗര്‍ദഭ കര്‍ണന്റെ പിന്‍ഗാമികളാണെന്ന്‌ വരുത്തിത്തീര്‍ക്കരുതേ എന്ന്‌ ഒരപേക്ഷയുണ്ട്‌."
കഥയുടെ കുഴപ്പം ഇത്രയേയുള്ളൂ. ദേവന്‍മാരുടെ മത്സരം അപ്പോളോ ദേവനും പാന്‍ എന്ന ദേവനും തമ്മിലായിരുന്നു. പാനിന്‍റെ കുഴല്‍വിളിയാണ് അപ്പോളോയുടെ തന്ത്രിവാദ്യ സംഗീതത്തെക്കാള്‍ നല്ലതെന്നു പറഞ്ഞ മൈഡാസിന് കഴുതച്ചെവി അപ്പോളോ സമ്മാനിച്ചത് മൈഡാസിന്‍റെ സംഗീതബോധത്തിന്‍റെ കുറവുകൊണ്ടാണോ അതോ അപ്പോളോയുടെ കൊതിക്കെറുകൊണ്ടാണോ?

ബൌദ്ധിക സ്വത്താവകാശവും ബൌദ്ധിക സത്യസന്ധതയും

മാസങ്ങള്‍ക്കുമുമ്പ് കേരള സ്റ്റേറ്റ് ഹയര്‍ എഡ്യുക്കേഷന്‍ കൌണ്‍സില്‍ സംഘടിപ്പിച്ച സെമിനാറില്‍ ഡോക്റ്റര്‍ ഇക്ബാല്‍ അവതരിപ്പിച്ച പേപ്പറാണ് വിഷയം. ബൌദ്ധിക സ്വത്താവകാശത്തെപ്പറ്റി ഒരു ദേശീയ സെമിനാറില്‍ കേരളത്തിലെ പ്രമുഖ അക്കാഡമിക്കായി അവതരിപ്പിക്കപ്പെടുന്ന ഡോക്റ്റര്‍ ബി. ഇക്ബാല്‍ അവതരിപ്പിച്ച പ്രബന്ധം അപ്പാടെ പകര്‍പ്പാണെന്നു വന്നാലോ? പ്രബന്ധം ഇവിടെ കാണാം.

പ്രബന്ധത്തില്‍ ഉദ്ദേശം 1680 പദങ്ങളുണ്ടെന്നാണ് മൈക്രോസോഫ്റ്റ് വേര്‍ഡ് ഉപയോഗിച്ചു കണക്കാക്കിയത്. ഇതില്‍ ഉദ്ദേശം 1000 പദങ്ങളും ഒരൊറ്റയാളുടെ രണ്ടു ലേഖനങ്ങളില്‍നിന്നായി പകര്‍ത്തിയതാണ്. ഡോക്റ്റര്‍ അമിത് സെന്‍ഗുപ്ത എന്ന ദേഹം എഴുതിയ രണ്ടു ലേഖനങ്ങളില്‍നിന്ന്. പകര്‍ത്തുക എന്നു പറയുമ്പോള്‍ ആശയം, കുറെ വാക്കുകള്‍ എന്നിവയൊക്കെ കടമെടുത്തു എന്നു ധരിക്കരുത്. select>copy>paste- അത്രമാത്രം. പകര്‍ത്തിയ ഭാഗങ്ങള്‍ കുറെയധികം താഴെ ഉദ്ധരിച്ചിട്ടുണ്ട്.

റെഫെറെന്‍സ് എന്ന പേരില്‍ ചില്ലറ പേരുകളും കൃതികളും മറ്റും പ്രബന്ധത്തിന്‍റെ അവസാനം കൊടുത്തിട്ടുണ്ടെങ്കിലും 1680-ല്‍ 1000 പദങ്ങളും പകര്‍ത്തിയ രണ്ടു ലേഖനങ്ങളോ അവയുടെ കര്‍ത്താവോ കൂട്ടത്തിലില്ല. ആദ്യത്തേത് ഡോക്റ്റര്‍ ഇക്ബാലിന്‍റെ സ്വന്തം പാര്‍ട്ടിയുടെ താത്ത്വിക പ്രസിദ്ധീകരണത്തിലാണ് വന്നിരിക്കുന്നത്. കോപ്പിറൈറ്റ് ലംഘനത്തിനു കേസൊന്നും വരില്ല. പോരെങ്കില് അമിത് സെന്‍ഗുപ്ത തന്‍റെ സുഹൃത്താണെന്നും തങ്ങള്‍ക്കിടയിലുള്ള സംഭാഷണത്തിന്‍റെ ഫലമായാണ് അമിത് സെന്‍ഗുപ്ത ആ ലേഖനങ്ങളെഴുതിയിരിക്കുന്നതെന്നും ഡോക്റ്റ്ര്‍ ഇക്ബാല്‍ ഈ ലേഖകനു മറുപടി തന്നിട്ടുണ്ട്. അമിത് സെന്‍ ഗുപത് പാര്‍ട്ടിക്കാരനാവാം, ലേഖനം വന്നത് പാര്‍ട്ടി പ്രസിദ്ധീകരണത്തിലാവാം, ഗുപ്തയ്ക്ക് ലേഖനം ഇക്ബാല്‍ പറഞ്ഞുകൊടുത്തതു തന്നെയാവാം. പക്ഷേ ഈ പ്രബന്ധാവതരണത്തില്‍ ഡോക്റ്റര്‍ ചില അടിസ്ഥാന അക്കാഡമിക് മൂല്യങ്ങളെയും മര്യാദകളെയും അവഗണിച്ചിരിക്കുന്നു.


ഒരു ദേശീയ സെമിനാറിലാണ് ഡോക്റ്ററെ പ്രബന്ധം അവതരിപ്പിക്കാന്‍ ക്ഷണിച്ചത്. ലോഹ്യക്കാരന്‍ ആറേഴു കൊല്ലം മുമ്പ് എഴുതിയ ലേഖനം അടുക്കും ചിട്ടയുമില്ലാതെ മുറിച്ചുതറിച്ചു പകര്‍ത്തി വായിക്കാനാണോ ഇദ്ദേഹത്തെ വിളിച്ചിരിക്കുന്നത്? ഇങ്ങനെ പകര്‍ത്തിവെച്ച നിലവാരമില്ലാത്ത ഈ പ്രബന്ധം പലരും തോണ്ടിയെടുത്ത് പലയിടത്തായി വിളമ്പുകയും ചെയ്തിട്ടുണ്ട്, എസ് എഫ് ഐക്കാര്‍ നടത്തുന്നതും നിരക്ഷരത പ്രകടമാക്കുന്നതുമായ വെബ്സൈറ്റില്‍ ഉള്‍പ്പെടെ. പറ്റിക്കലല്ലേ പച്ചയായി പറഞ്ഞാല്‍ ഇത്?


ഇങ്ങനെ ആരാന്‍റെ സൃഷ്ടി തന്‍റേതെന്ന ഭാവേന എടുത്തുപയോഗിക്കുന്ന ഏര്‍പ്പാടിന് ഇംഗ്ലീഷില്‍ plagiarism എന്നു പറയും. നോക്കണേ, ബൌദ്ധികസ്വത്തവകാശമാണ് വിഷയം! പ്ലെയ്ജറിസം നടത്താന്‍ ഇതിലും യോജിച്ച വിഷയം വേറെയുണ്ടോ. വിദ്യാര്‍ത്ഥികള്‍ പോലും ചെയ്യാന്‍ പാടില്ലാത്ത നെറികേടാണ് പ്ലെയ്ജറിസം. പ്ലെയ്ജറിസത്തെപ്പറ്റിയുള്ള വിക്കിപീഡിയ ലേഖനത്തില്‍ കാണുന്നത് "in many universities, academic degrees or awards may be revoked as a penalty for plagiarism" എന്നാണ്. വിദ്യാര്‍ഥികളുടെ കാര്യത്തില്‍ ഇങ്ങനെയെങ്കില് വിദ്യാഭ്യാസത്തിലും intellectual propertyയെ സംബന്ധിച്ചും പണ്ഡിതനും (?) ശാസ്ത്ര സാഹിത്യ പരിഷത്തിന്‍റെ സൈദ്ധാന്തികനും ഒരു യൂനിവേര്‍സിറ്റിയുടെ മുന്‍ വൈസ്ചാന്‍സലറും ആയ ദേഹം ഇതു ചെയ്താല്‍? ഏകദേശം ഒരു മാസം മുമ്പ് ഈ വിഷയത്തില്‍ ഈ ബ്ലോഗെറും ഡോ ഇക്ബാലും ചില ഇമെയില്‍ സന്ദേശങ്ങള്‍ കൈമാറുകയുണ്ടായി. അവയില്‍ ഞാന്‍ ഇക്ബാലിനയച്ച് രണ്ടു സന്ദേശങ്ങളും ഇവിടെ ചേര്‍ക്കുന്നു. അവകൂടി ചേര്‍ത്തുവായിച്ചാലേ കഥ വ്യക്തമാവുകയുള്ളൂ. ഇക്ബാലിന്‍റെ മറുപടി അദ്ദേഹത്തിന്‍റെ അനുമതിയോടെയേ പൂര്‍ണ്ണരൂപത്തില്‍ ചേര്‍ക്കാന്‍ കഴിയൂ. എന്‍റെ ആദ്യത്തെ സന്ദേശത്തിന് മറുപടിയില്‍ "I have the freedom to make use of the ideas generated thus in the article" എന്നു തികഞ്ഞ ആത്മവിശ്വാസത്തോടെ ഒട്ടും കുറ്റബോധമില്ലാതെ ഡോക്റ്റര്‍ പറയുന്നു. അതായത് താനും ഗുപ്തയും ചര്‍ച്ചചെയ്തതു പ്രകാരം ഗുപ്ത എഴുതിയ ലേഖനത്തില്‍നിന്ന് എനിക്ക് യഥേഷ്ടം പകര്‍ത്താം എന്ന്. അങ്ങനെയോ എന്ന് ഈ ബ്ലോഗെര്‍ സെന്‍ഗുപ്തയോടു ചോദിച്ചു. മുകളില്‍ രണ്ടാമതായി കൊടുത്ത 2004-ലെ പേജില്‍ കാണുന്ന ഇമെയില്‍ ഐഡിയിലാണ് അന്വേഷിച്ചത്. ഒരു മറുപടിയും വന്നില്ല. വീണ്ടും ഓര്മ്മിപ്പിച്ചു, എന്നിട്ടും മറുപടിയില്ല. ഏതായാലും 1000 പദങ്ങളും ഒറ്റയാളില്‍നിന്ന് പകര്‍ത്തിയിട്ടും അത് acknowledge ചെയ്യാതിരുന്നിട്ടും തന്‍റെ ചെയ്തിയില്‍ കുഴപ്പമില്ല (ഗുപ്തയുടെ പേര് റെഫെറെന്‍സുകളുടെ കൂട്ടത്തില്‍ കൊടുക്കേണ്ടതായിരുന്നെന്ന് അദ്ദേഹം സമ്മതിച്ചു) എന്ന ഇക്ബാലിന്‍റെ നിലപാട് എന്നെ അരിശം കൊള്ളിച്ചു. ആ നിലപാടിനെ പരിഹസിച്ചുകൊണ്ട് രണ്ടാമത് ഒരു സന്ദേശം കൂടി ഞാനയച്ചു. ഗുപ്തയുടെ ലേഖനങ്ങള്‍ മാത്രമല്ല പ്രബന്ധത്തില്‍ പകര്‍ത്തിവെച്ചിരിക്കുന്നത് എന്നു കാണിക്കാനായി മറ്റൊരു source-ല്‍നിന്ന് പകര്‍ത്തിയ വലിയൊരു ഖണ്ഡികയും ഞാന്‍ ഉദ്ധരിച്ചു. രണ്ടാമത്തെ സന്ദേശവും താഴെക്കാണാം. ഏതായാലും ഇതോടെ ഡോക്റ്റര്‍ ഇക്ബാലിന്‍റെ നിലപാടില്‍ മാറ്റം വന്നെന്നു തോന്നുന്നു. താനൊരു scholar അല്ലെന്നും activist ആണെന്നും പ്രബന്ധത്തെപ്പറ്റി എന്‍റെ വിമര്‍ശനം ശരിയാണെന്നും അദ്ദേഹം മറുപടി തന്നു. ഇക്ബാലിനും എനിക്കും മാത്രം ഇടയിലുള്ള പ്രശ്നമായിരുന്നു ഇതെങ്കില്‍ ഇക്കാര്യം അവിടെ സമാപിപ്പിക്കാമായിരുന്നു. പ്രശ്നം അതല്ലല്ലോ. ഇത്തരക്കാരാണ് ഇവിടത്തെ വിദ്യാഭ്യാസത്തിന്‍റെ agenda setters എന്നതാണ് പ്രശ്നം.

The paper was brought to my notice by a Professor at CUSAT (stranger to me except for some one-sided email messages) who frequently mails with topics related to academic issues in Kerala.
This person sent me a link to a ridiculous and uneducated website run by SFI where your paper can be viewed. The contents of the website are copyright protected. The appearance of an academic paper on a website of a semi-literate nature rather surprised me and I made some Google searches with excerpts from the paper to find its original source. I found that the Higher Education Council Website as well as another website displays the paper. However, more surprisingly, I found that most of the excerpts I searched with belonged to other articles available online. And all of them precede your paper by years.


I looked more closely and checked your credits. None of them is specific and the text doesn't distinguish any part as direct quotes. I don't think that you, a renowned academic in Kerala, could be unaware of the practice of attributing sources. Even an idea borrowed from an article or book needs to be duly credited. In your article not only ideas but also large chunks of text are seen copied word for word.


For example see this chunk:"IPR is nothing more than State-mandated monopolies. The idea behind such rights is that the fundamentals of an invention are made public while the inventor, for a limited period of time, has the exclusive right to make, use, or sell, the invention. Discoverers and inventors are thought to deserve special rewards or privileges because their discoveries and inventions benefit society. The public good is not considered a reward in itself and therefore these incentives to encourage invention or innovation. The whole argument regarding IPR is built on a contradiction: that in order to promote the development of ideas, it is necessary to reduce the freedom with which people can use them."

But drugs which sell in the market may have little to do with the actual health needs of the global population -- for, often, there is nobody to pay for drugs required to treat diseases in the poorest countries. Research and patenting in pharmaceuticals are driven, not so much by actual therapeutic needs, but by the need of companies to maintain their super profits at present levels. As a consequence, we are looking to a new situation, where 10-12 large Transnational conglomerates will survive as "research based" companies that will be in the business of drug development and patenting. Thanks for your reply.
I cannot decide if I should be surprised over your notion of using and attributing sources when you use verbatim text from already published sources and present it as a paper at a national seminar. What is amiss about this is evident in your own reply. You have the freedom to "make use of the ideas" (of course, with due credit) but you don't have the freedom to copy more than a thousand words from other published sources in a paper of about 1680 words. (The MS Word counts whole text and copied parts 1680 against 1000.)


Even if it were your own publications, this would be deprecated because you are being given a chance to present something original (not a rehashment of the already published material) at a national seminar.


Doing it without crediting is in poor taste.


Besides, the remaining parts of your paper also seem to be copied from other sources.

I can show many individual sentences as coming from diverse sources. I wonder if the paper contains any sentence that is your own.Maybe, your attitude reflects the state of affairs in the academic practice of Kerala. If you think you can copy text without the use of quotation marks and proper attribution in an academic paper, sorry to say, your idea of academic publication is seriously flawed. I feel that this matter needs to be discussed in public.

മാതൃഭൂമി തൊഴില്‍വാര്‍ത്തയും വിവരാവകാശ നിയമവും

തൊഴില്‍ വാര്‍ത്തയില്‍ വിവരാവകാശ നിയമത്തെപ്പറ്റി വന്ന അബദ്ധജടിലവും ദുരുപദിഷ്ടവുമായ ലേഖനമാണ് ഈ കുറിപ്പെഴുതാന്‍ പ്രേരണ. RTI ആക്റ്റിനെപ്പറ്റി ഒരു ഗന്ധവുമില്ലാത്ത ആരോ പടച്ച ഈ ലേഖനം കള്ളനു ചൂട്ടുപിടിക്കാനുദ്ദേശിച്ചുള്ളതാണെന്നു വ്യക്തം.
“സാമൂഹ്യബോധമില്ലാത്ത ചില വ്യക്തികള്‍” “യാതൊരു പ്രയോജനവുമില്ലാത്ത ചോദ്യങ്ങള്‍” ചോദിച്ച് വിവരാവകാശ നിയമം “നിന്ദ്യമായി ദുരുപയോഗം ചെയ്യുന്നു”വെന്നാണ് ലേഖകന്‍റെ ആക്ഷേപം. കഴിഞ്ഞ 20 വര്‍ഷക്കാലത്ത് എത്ര പേര്‍ ബി.എ. പരീക്ഷയെഴുതി, അതില്‍ ആണെത്ര, പെണ്ണെത്ര, അവരില്‍ എത്ര പേര്‍ക്ക് ഫസ്റ്റ്ക്ലാസുണ്ട് എന്നൊക്കെ ചോദിച്ചുകളയുന്നുവത്രേ. ഇങ്ങനെ ലോകത്തൊരാള്‍ക്കും പ്രയോജനമില്ലാത്ത വിവരങ്ങളാണത്രേ ആളുകള്‍ തേടുന്നത്. 30 ദിവസത്തിനകം മറുപടി നല്കിയിരിക്കണമെന്ന് നിബന്ധനയുള്ളതിനാല്‍ ബന്ധപ്പെട്ട ജീവനക്കാരന്‍ ഉടന്‍തന്നെ മറ്റെല്ലാ ജോലികളും മാറ്റിവെച്ച് ഇതിന്‍റെ കണക്കെടുക്കാന്‍ നടക്കുകയായത്രേ. ഇതുകാരണം യുവജനങ്ങളുടെ ഭാവി തകര്‍ന്നടിയുന്നത്രേ. ഇങ്ങനെ ലേഖകന്‍ വിലപിച്ച ശേഷം പിന്നെ നിയമത്തിന്‍റെ വ്യാഖ്യാനമുണ്ട്. നിയമോപദേശമുണ്ട്. നിയമം ശരിക്കു മനസ്സിലാക്കി പ്രവര്‍ത്തിക്കണമെന്നു യൂനിവേര്‍സിറ്റികളെയും പി. എസ്. സിയെയും ഉദ്ബോധിപ്പിക്കുന്നുണ്ട്. അവസാനം അല്പന്മാരുടെ പതിവു വിഭവമായ പിന്‍കുറിപ്പുമുണ്ട്.
ലോകത്താര്‍ക്കും പ്രയോജനമില്ലാത്ത വിവരങ്ങളെപ്പറ്റി ആദ്യം പരിശോധിക്കാം. ഇരുപതു വര്‍ഷത്തിനുള്ളില്‍ എത്ര പേര്‍ ബി ഏ പരീക്ഷയെഴുതിയെന്നതിന്‍റെ ആണും പെണ്ണും വേര്‍തിരിച്ചുള്ള കണക്ക് ആരെങ്കിലും ചോദിച്ചോ അതോ ലേഖകന്‍റെ സങ്കല്പനമാണോ എന്നറിയില്ല. എന്നാല്‍ ഈ വിവരം സമൂഹശാസ്ത്ര രഗംത്ത് അന്വേഷണം നടത്തുന്ന ഒരാള്‍ക്ക് വളരെ പ്രധാനമായിരിക്കാം (അതു വഴി സമൂഹത്തിനുതന്നെയും) എന്ന് ഈ അല്പബുദ്ധി മനസ്സിലാക്കുന്നില്ല. ഇതു മനസ്സിലാക്കാന്‍ ഒരു സാഹചര്യം വിവരിക്കാം. സമീപകാലത്തായി തൊഴിലധിഷ്ഠിതമല്ലാത്ത ഉന്നതവിദ്യാഭ്യാസ രംഗത്ത് പെണ്‍കുട്ടികളുടെ എണ്ണം വളരെക്കൂടുതല്‍ വര്‍ദ്ധനവ് രേഖപ്പെടുത്തുന്നു എന്നു പൊതുവേ പറയപ്പെടുന്നു, ഉദാഹരണത്തിന് യൂനിവേഴ്സ്റ്റികളിലെ ഡിപാര്‍ട്മെന്‍റുകളില്‍. ആണ്‍കുട്ടികള്‍ തൊഴിലധിഷ്ഠിതമായ പഠനത്തിലേക്കു നീങ്ങുന്നതാണ് ഇതിനു കാരണമായി പറയുന്നത്. ഈ വിഷയത്തില്‍ ഔദ്യോഗികമായി വല്ല കണക്കുകളും ലഭ്യമാണോ എന്നറിയില്ല. ലേഖകന്‍റെയൊക്കെ ബുദ്ധി നിലവാരമേ സര്‍ക്കാരിനും സര്‍വ്വകലാശാലകള്‍ക്കും ഉളളൂ എന്നതിനാല്‍ എളുപ്പം ലഭിക്കുന്ന നിലയില്‍ സ്ഥിതിവിവരക്കണക്കൊന്നും ലഭ്യമല്ല. നമ്മുടെ നാട്ടില്‍ എന്നെന്നും സജീവമായി നില്ക്കുന്ന ഒരു സമൂഹ പ്രശ്നമായ സംവരണത്തിന്‍റെ ഫലങ്ങളെപ്പറ്റി അറിയണമെങ്കില്‍ അധസ്ഥിത വിഭാഗങ്ങളിലെ എത്ര കുട്ടികള്‍ പത്താം ക്ലാസും പ്രീഡിഗ്രിയും പ്ലസ് റ്റുവും ബി ഏയും എം ഏയും ഒക്കെ പാസായി എന്നു കണക്കെടുത്തേ പറ്റൂ. ഇതൊക്കെ ലോകത്താര്‍ക്കും പ്രയോജനമില്ലാത്ത വിവരമാണത്രേ.
ഇത്തരം ചോദ്യങ്ങള്‍ വരുമ്പോള്‍ ഓരോ തവണയും ചെയ്യുന്ന പണി ഉപേക്ഷിച്ച് ഈ കണക്കെടുപ്പിനു പോവുമെന്നാണോ വിവരാവകാശ നിയമം വിഭാവനം ചെയ്യുന്നത്? ലേഖനമെഴുതിയ കുബുദ്ധി സാമാന്യബുദ്ധിയെങ്കിലും പ്രയോഗിക്കേണ്ടതായിരുന്നു ഇവിടെ. വിവരാവകാശ നിയമത്തിന്‍റെ നാലാം വകുപ്പു പറയുന്ന കാര്യം ഇയ്യാള്‍ വായിച്ചിട്ടുണ്ടോ എന്തോ. നിയമം നിലവില്‍വന്ന് 120 ദിവസങ്ങള്‍ക്കകം സര്‍ക്കാരുകളും സ്ഥാപനങ്ങളും ചെയ്തിരിക്കണമെന്ന് നിയമം അനുശാസിക്കുന്ന ചില കാര്യങ്ങളാണ് അവിടെക്കാണുക. എന്താണ് അതിന്‍റെ അര്‍ത്ഥം? ഇക്കാലമത്രയും യാതൊരു എക്കൌണ്ടബിലിറ്റിയും ഇല്ലാതെ നടന്നുപോന്ന സ്ഥാപനങ്ങളെ നേര്‍വഴിക്കു നടത്തുക എന്ന ഉത്തരവാദിത്വം കൂടി ഈ നിയമത്തിനുണ്ട്. വിവരങ്ങള്‍ ഫയലില്‍ കെട്ടിവെച്ചാല്‍ പോരാ, സുതാര്യത വേണമെങ്കില്‍ ഈ വിവരം ജനത്തിനു ലഭ്യമാവുക കൂടിവേണം. ഡിഗ്രികള്‍ സര്‍റ്റിഫിക്കറ്റു രൂപത്തില്‍ കൊടുത്തുവിടുന്നതോടൊപ്പം എത്ര കൊടുത്തു എന്ന കണക്കെഴുതി വെയ്ക്കാന്‍ ആവതില്ലാത്ത സ്ഥാപനങ്ങളാണ് ഇവയെങ്കില്‍ ആദ്യം വേണ്ടത് അവയെ നേരേചൊവ്വേ നടത്തുകയാണ്. ഇതാണ് വിവരാവകാശ നിയമത്തിന്‍റെ പ്രസക്തിയും.
ഏതാനും പതിനായിരമോ അല്ലെങ്കില്‍ ഏതാനും ലക്ഷങ്ങളോ മാത്രം വരുന്ന കണക്കു സൂക്ഷിപ്പ്. അതു ചെയ്യാനാവില്ലേ ഈ സ്ഥാപനങ്ങള്‍ക്ക്? അതുചെയ്യില്ല, ചെയ്യേണ്ടതില്ലെന്നാണ് വിചാരിക്കുന്നത് എന്നത് മറ്റൊരു കാര്യം. ജീവനക്കാരന്‍റെ സര്‍വ്വീസ് ബുക്കും ലീവു സറണ്ടറും മറ്റു കുന്ത്രാണ്ടങ്ങളും സൂക്ഷിക്കാനും പാലിക്കാനുമാണ് ഇവിടെ സര്‍വകലാശാലകള്‍. ചുരുക്കത്തില്‍ അവയുടെ പ്രധാന ഏര്‍പ്പാട് ജീവനക്കാരെ തീറ്റിപ്പോറ്റുക എന്നതാണ്. അതിനുവേണ്ടി വിദ്യാഭ്യാസം എന്ന പേരി‍ല്‍ ചില അഭ്യാസങ്ങളൊക്കെ ഉണ്ടാവുമെന്നു മാത്രം. ജീവനക്കാരുടെ സര്‍വ്വീസ് രേഖകള്‍ സൂക്ഷിക്കുന്നത്ര പ്രാധാന്യത്തോടെ വിദ്യാഭ്യാസ സംബന്ധമായ കാര്യങ്ങളിലെ രേഖകള്‍ സൂക്ഷിക്കണമെന്ന് ഇവയ്ക്ക് നിര്‍ബന്ധമില്ല.

ഈ ലേഖകനില്‍നിന്ന് സ്വാഭാവികമായും ഉയര്‍ന്നുവരാവുന്ന മറ്റൊരു ചോദ്യം ഞാന്‍ മുന്‍കൂട്ടി കാണട്ടെ. എന്തിനാണ് പത്തുനൂറുകോടി ജനങ്ങളുടെ എണ്ണമെടുക്കുന്ന ഈ ഏര്‍പ്പാട്? വാദ്ധ്യാന്മാരും മറ്റു ഉദ്യോഗസ്ഥന്മാരും അവരുടെ പണിയൊക്കെ മാറ്റിവെച്ച് ലോകത്താര്‍ക്കും പ്രയോജനമില്ലാത്ത ജനസംഖ്യാ കണക്കെടുപ്പിന് നടക്കുന്നത് എന്തൊരു കഷ്ടമാണ്. ഇത്തരം വിഡ്ഢികളെയല്ല പറയേണ്ടത്, ഇവര്‍ കാളമൂത്രം പോലെ ഒഴുക്കിവിടുന്ന ദുര്‍ഭാഷണത്തിനു താളുകള്‍ ചെലവിടുന്ന പത്രാധിപന്മാരെയാണ് പറയേണ്ടത്.
വിവരങ്ങള്‍ ഡിജിറ്റൈസ് ചെയ്ത് എളുപ്പം ലഭ്യമാവുന്ന വിധത്തില്‍ സൂക്ഷിക്കണം എന്നുകൂടി നിയമത്തില്‍ മേല്പറഞ്ഞ ഭാഗത്ത് പറയുന്നുണ്ട്. ഇവിടെ പ്രസക്തമായ മറ്റൊരു കാര്യമുണ്ട്. വിവരാവകാശ നിയമവും വിവര സാങ്കേതിക വിദ്യയും തമ്മിലുള്ള ബന്ധം. ഇത്തരം ഒരു നിയമത്തെ സാദ്ധ്യമാക്കുന്നതില്‍ വിവര സാങ്കേതിക വിദ്യയ്ക്ക് വളരെ പ്രധാനമായ പങ്കുണ്ട്. ഇന്‍ഫര്‍മേഷന്‍ സംഭരിക്കാനും അത് എളുപ്പം ലഭ്യമാക്കാനും ഇന്‍ഫര്‍മേഷന്‍ റ്റെക്നോളജിക്കു കഴിയുമെന്നതുകൊണ്ടു കൂടിയാണ് വിവരാവകാശ നിയമം പ്രാവര്‍ത്തികമാവുന്നത്. ഇന്‍ഫര്‍മേഷന്‍ മേനേജ്മെന്റ് എന്നൊരു കാര്യം നമ്മുടെ നാട്ടില്‍ ആപ്പീസു പ്രവര്‍ത്തന രീതിയില്‍ പൊതുവെ അജ്ഞാതമായിരുന്നു. തിരച്ചില്‍ ഫീസ് എന്നു കേട്ടിട്ടില്ലേ. പല കാര്യത്തിനും സര്‍ക്കാര്‍ ഈടാക്കുന്ന ഈ പീസ് നിലനില്‍ക്കുന്നു എന്നതുതന്നെ കെടുകാര്യസ്ഥതയുടെ തെളിവാണ്. ഒരു കടലാസു കിട്ടണമെങ്കില്‍ ഒരാപ്പീസിലെ ഫയലുകെട്ടുകള്‍ മുഴുവന്‍ തിരയുക എന്ന പരിപാടിയില്‍നിന്നാണ് ഈ പീസിന്‍റെ ഉദ്ഭവമെന്ന് സാമാന്യമായി പറയാം. കംപ്യൂട്ടറുപയോഗിച്ചു നടത്തുന്ന പ്രവര്‍ത്തനങ്ങളില്‍ ഈ തിരച്ചിലും പീസുമൊന്നും വരാന്‍ സ്കോപ്പില്ല. (കംപ്യൂട്ടറിനെ കംപ്യൂട്ടറെന്ന നിലയിലാണ് ഉപയോഗിക്കുന്നതെങ്കില്‍).
ഒരു യൂനിവേര്‍സിറ്റി ഡിപാര്‍ട്മെന്‍റില്‍ എത്ര വിദ്യാര്‍ത്ഥികള്‍ പഠിക്കുന്നു, അവരില്‍ ആണെത്ര, പെണ്ണെത്ര, ജാതി തിരിച്ചു കണക്ക്, എത്ര പേര്‍ ജയിച്ചു, എത്ര പേര്‍ തോറ്റു എന്നതൊക്കെ ഓരോ വര്‍ഷവും തയ്യാറാക്കുന്ന കണക്കുകളില്‍ പെടുന്നതാണ്. ഈ കണക്കുകളെ ചേര്‍ത്തുവെച്ച് ലേഖകന്‍ പറയുന്ന ലോകത്താര്‍ത്തും പ്രയോജനമില്ലാത്ത ചോദ്യങ്ങള്‍ക്ക് ഉത്തരം പറയുകയെന്ന നിസ്സാര കാര്യം ചെയ്യാന്‍ വയ്യെങ്കില്‍ അതു നിയമത്തിന്‍റെയോ ചോദ്യം ഉന്നയിക്കുന്നവരുടെയോ കുഴപ്പമല്ല. ലേഖകന്‍റേതുപോലെ തരംതാണ നിലവാരമുള്ള യൂനിവേര്‍സിറ്റി അധികൃതരുടെ ബുദ്ധിയുടെ കുഴപ്പമാണ്.

സ്വന്തം അല്പബുദ്ധി ലേഖകന്‍ എങ്ങനെ വെളിവാക്കുന്നു എന്നുകൂടി പറയുന്നത് ഉചിതമായിരിക്കും.
“പൊതുപ്രവര്‍ത്തനവുമായോ പൊതുതാത്പര്യവുമായോ ബന്ധമില്ലാത്തതും വ്യക്തിയുടെ സ്വകാര്യതയിലേക്കു കടന്നുകയറ്റം നടത്തുന്നതുമായ വിവരങ്ങള്‍ ആവശ്യപ്പെട്ടാല്‍ വെളപ്പെടുത്തേണ്ടതില്ലെന്ന് ...
നിയമത്തില്‍ വ്യക്തമാക്കുന്നുണ്ട് (എട്ടാം വകുപ്പിന്‍റെ ജെ ഖണ്ഡിക).
ആ ഖണ്ഡിക ഇതാ:
(j) information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information:

ഞാന്‍ ഹൈലൈറ്റ് ചെയ്തിരിക്കുന്ന ഭാഗത്തുനിന്നാണ് ഈ ക്ലോസ് പറഞ്ഞു തുടങ്ങുന്നത്. വ്യക്തിപരമായ വിവരങ്ങളാണെങ്കില്‍ അതു വെളിപ്പെടുത്തണമെങ്കില്‍ മേല്പറയുന്ന വ്യവസ്ഥകളുണ്ടെന്ന്. അതിന് പൊതു താത്പര്യവുമായി ബന്ധം വേണം, അതു വ്യക്തിയുടെ സ്വകാര്യതയെ ഹനിക്കുന്നതാവരുത്. ഈ ആരംഭം എടുത്തു കളഞ്ഞാണ് അല്പബുദ്ധിയായ (കുബുദ്ധിയായ) ലേഖകന്‍ തന്‍റെ വ്യാഖ്യാനം ചമച്ചിരിക്കുന്നത്. ലേഖകന്‍ നാണമില്ലാതെ എഴുന്നെള്ളിക്കുന്ന കള്ളവ്യാഖ്യാനപ്രകാരം പൊതുതാത്പര്യവുമായി ബന്ധമില്ലെന്നു പറഞ്ഞ് പല അപേക്ഷകളും കേരളത്തിലെ സര്‍ക്കാരാപ്പീസുകളിലും യൂനിവേര്‍സിറ്റികളിലും നിരസിക്കപ്പെടുമെന്ന് ഉറപ്പാണ്. ഇതു വായിച്ച് പാവം ജനവും കരുതും പൊതുതാത്പര്യം മുന്‍നിറുത്തി ഹരജി നല്കാനുള്ള സംവിധാനമാണ് ഇതെന്ന്. സ്വന്തം പ്രമോഷന്‍ തടഞ്ഞുവെച്ചതിനെപ്പറ്റി ചോദിക്കുന്ന ഒരു ഗുമസ്തന്‍റെ ചോദ്യം പൊതുപ്രവര്‍ത്തനവുമായോ പൊതുതാത്പര്യവുമായോ എങ്ങനെയാണ് ബന്ധപ്പെടുകയെന്ന് ഈ വിവരദോഷിയോട് ചോദിക്കേണ്ടതാണ്?
വീണ്ടും:
“ഏതെങ്കിലുമൊരാള്‍ മറ്റൊരു വ്യക്തിയെക്കുറിച്ചുള്ള വിവരങ്ങള്‍ നല്കാനാവശ്യപ്പെട്ടാല്‍ അവ നേരെയങ്ങു നല്കാന്‍ പാടില്ല. ബന്ധപ്പെട്ട വ്യക്തിക്ക് ഇതു സംബന്ധിച്ച് നോട്ടീസ് നല്കണം. അയാളുടെ പ്രതികരണം നേരിട്ട് വാക്കാലോ രേഖാമൂലമോ ലഭിച്ചതിനുശേഷം അതിന്‍റെ അടിസ്ഥാനത്തിലാവണം വിവരങ്ങള്‍ നല്കുകയോ നല്കാതിരിക്കുകയോ വേണ്ടതെന്നും നിയമത്തില്‍ വ്യക്തമാക്കുന്നു (പതിനൊന്നാം വകുപ്പിന്‍റെ ഒന്നാം ഖണ്ഡിക).”
ശരാശരി നിലവാരത്തില്‍ കവിഞ്ഞ ഒരു മണ്ടന്‍റെ വ്യാഖ്യാനമാണ് ഇതെന്നു പെട്ടെന്നു തോന്നിപ്പോവാം. കാരണം ആക്റ്റിലെ ഈ ഖണ്ഡിക ഇങ്ങനെയാണ്.
11. (1) Where a Central Public Information Officer or a State Public Information Officer, as the case may be, intends to disclose any information or record, or part thereof on a request made under this Act, which relates to or has been supplied by a third party and has been treated as confidential by that third party, the Central Public Information Officer or State Public Information Officer, as the case may be, shall, within five days from the receipt of the request, give a written notice to such third party of the request and of the fact that the Central Public Information Officer or State Public Information Officer, as the case may be, intends to disclose the information or record, or part thereof, and invite the third party to make a submission in writing or orally, regarding whether the information should be disclosed, and such submission of the third party shall be kept in view while taking a decision about disclosure of information:
മുകളിലെ ഉദാഹരണത്തിലെന്ന പോലെ അല്പബുദ്ധി ഇവിടെയും മര്‍മ്മം (ഹൈലൈറ്റ് ചെയ്ത ഭാഗം) കണ്ടിട്ടില്ല. എന്നാല്‍ മണ്ടനെന്നു പറഞ്ഞ് എഴുതിത്തള്ളാന്‍ വരട്ടെ. തുടര്‍ന്നു പറയുന്നത് കാണുക:
“എന്നാല്‍ ഇതൊന്നും വ്യക്തമായി പഠിക്കാനും മനസ്സിലാക്കാനും [അതായത് ഈ അല്പബുദ്ധി വ്യാഖ്യാനിച്ച പ്രകാരം!] ശ്രമിക്കാതെ, വിവരാവകാശ നിയമമെന്നാല്‍ വ്യക്തി ചോദിക്കുന്നതെല്ലാം നല്കുകയാണെന്ന് തെറ്റായി ധരിച്ച്, കാണുന്ന ചോദ്യങ്ങള്‍ക്കെല്ലാം ഉത്തരം തയ്യാറാക്കി നല്കാനായി വിലപ്പെട്ട സമയം പാഴാക്കുകയാണ് സര്‍വകലാശാലയിലെയും പി. എസ്. സി. യിലെയും മറ്റും മിക്ക ജീവനക്കാരുമെന്നത് വിദ്യാര്‍ത്ഥികളും തൊഴിലന്വേഷകരുമായ യുവതലമുറയുടെ ദുരന്തമായി മാറിയിരിക്കുന്നു.”
അഹോ, എന്തൊരു കഥ! പി. എസ്. സി. യിലെയും സര്‍വകലാശാലകളിലെയും മിക്ക ജീവനക്കാരും ഇപ്പോള്‍ വിവരാവകാശ നിയമപ്രകാരമുള്ള അപേക്ഷകള്‍ക്ക് ഉത്തരം നല്കുന്ന പണിയാണ് ചെയ്തുവരുന്നതത്രേ. ലേഖകന്‍റെ കാപട്യം വെളിപ്പെടുന്നു ഇവിടെ. കാലിക്കറ്റ് യൂനിവേര്‍സിറ്റിയുടെ കാര്യം ഇതെഴുതുന്ന ആള്‍ക്കറിയാം. അവിടെ മിക്ക ജീവനക്കാര്‍ പോയിട്ട് ഒരു പത്തുപേര്‍ പോലും ഇതിനായി സമയം “പാഴ്” ആക്കുന്നില്ല. അല്പബുദ്ധിയല്ല, ദുഷ്ടബുദ്ധിയാണ് ഇവിടെ തെളിയുന്നത്. സര്‍വകലാശാലകളുടെയും സര്‍ക്കാര്‍ സ്ഥാപനങ്ങളുടെയും തലപ്പത്തിരിക്കുന്ന പല നെറികെട്ടവന്മാരുടെയും പേടിസ്വപ്നമായിരുന്നു വിവരാവകാശ നിയമം. ഇപ്പോള്‍ നിയമത്തെ ഫലപ്രദമായി അട്ടിമറിക്കാന്‍ പഠിച്ചിരിക്കയാല്‍ പേടി കുറഞ്ഞുകാണും. ഈ നിയമത്തെ കേരളത്തിലെപ്പോലെ ഫലപ്രദമായി അട്ടിമറിക്കാന്‍ മറ്റെവിടെയെങ്കിലും കഴിഞ്ഞിട്ടുണ്ടോ എന്നത് അന്വേഷിക്കേണ്ടതാണ്. അത്രയ്ക്കാണ് ഇവിടത്തെ ഉദ്യോഗസ്ഥവൃന്ദത്തിന്‍റെ സംഘടിതശക്തി. കാടന്‍ സംസ്ഥാനമായ ഝാര്‍ഖണ്ഡില്‍നിന്നുപോലും വിവരാവകാശ നിയമം ഉപയോഗിച്ച് ബ്യൂറോക്രസിയെ നിലയ്ക്കുനിറുത്തിയ കഥകള്‍ ഇപ്പോഴും കേള്‍ക്കാം. ഇവിടെയാവട്ടെ ഉത്തരമായി തോന്ന്യാസം എഴുതിക്കൊടുക്കും. മാതൃഭൂമിയുടെ തൊഴില്‍വാര്‍ത്ത പോലുള്ള പ്രസിദ്ധീകരണത്തില്‍ നിയമത്തെ ദുര്‍വ്യാഖ്യാനം ചെയ്തു കള്ളനു ചൂട്ടുപിടിച്ചു കൊടുക്കും.
അവസാനമായി ലേഖകന്‍റെ പിന്‍കുറിപ്പു കൂടു പരാമര്‍ശിക്കേണ്ടതാണ്.
“പരീക്ഷാഫലം വൈകുന്നതു സംബന്ധിച്ച് വിവരാവകാശ നിയമപ്രകാരം ലഭിച്ച കത്തിനു മറുപടി നല്കാന്‍ എത്ര ദിവസങ്ങള്‍ ചെലവഴിച്ചുവെന്നും ഇതിലും കുറഞ്ഞ സമയം കൊണ്ട് ഇത്തവണ പരീക്ഷാഫലം പ്രസിദ്ധീകരിക്കാന്‍ കഴിയുമായിരുന്നില്ലേ എന്നും ചോദിക്കുന്ന ഒരു കത്തിന് സര്‍വകലാശാല നല്കുന്ന മറുപടി എന്തായിരിക്കും?”
ലേഖകന്‍റെ rhetorical question ആണിത്. ദുഷ്ടബുദ്ധിയും അല്പബുദ്ധിയും ചേര്‍ന്നാലും അങ്ങേയറ്റം തരംതാണ അല്പബുദ്ധിക്കു തന്നെയാണ് മേല്ക്കോയ്മ എന്നാണ് ഈ പിന്‍കുറിപ്പ് വ്യക്തമാക്കുന്നത്.
വിവരാവകാശ നിയമം വിവരം അറിയാനുള്ളതാണ് വിഡ്ഡീ, അഭിപ്രായം ചോദിക്കാനുള്ളതല്ല എന്നാണ് ഈ ലേഖകന്‍റെ ചോദ്യത്തിനുള്ള മറുപടി.
തൊഴില്‍വാര്‍ത്ത നോക്കി പി. എസ്. സി. ചോദ്യങ്ങള്‍ തയ്യാറാക്കുന്നതിനെപ്പറ്റി തൊഴില്‍വാര്‍ത്ത തന്നെ വമ്പിച്ച അവകാശ വാദങ്ങള്‍ ഉന്നയിക്കുന്നുണ്ട്. ഇതു ശരിയാണെങ്കില്‍ ഈ ലേഖകന്‍റെ ദുഷ്ടത വായിച്ച് വിവരാവകാശ നിയമ പ്രകാരമുള്ള അപേക്ഷകളില്‍ നല്കേണ്ടുന്ന വിവരങ്ങള്‍ പി. എസ്. സി. യും സര്‍വകലാശാലകളും നല്കാതിരിക്കുമെന്നും ഊഹിക്കാം. സമൂഹവിരുദ്ധമായ ഈ റോള്‍ വഹിക്കണോ താങ്കളുടെ പ്രസിദ്ധീകരണം? ലേഖകന്‍ എഴുതിക്കൂട്ടിയ അനര്‍ത്ഥങ്ങള്‍ തള്ളിക്കളഞ്ഞ് തെറ്റുപറ്റിയെന്നു സമ്മതിക്കുന്നതല്ലേ ഉചിതം? ഏതിനും തീരുമാനം താങ്കളുടേത്.
